JAZZIZ Discovery Program Agreement

Once selected for inclusion in the JAZZIZ Discovery Program (the “Program”), JAZZIZ will feature your album on its official website and in its monthly digital flipbook magazine. A dedicated page will highlight your album and may include links to commercial streaming services, the artist’s official website, and/or other locations where the album may be purchased or streamed. The page will also provide a downloadable track for JAZZIZ subscribers, which will be available for a period of one (1) month coinciding with the issue in which the album is featured.

Performance License and Representations

With respect to the musical performance (the “Performance”) you are submitting for inclusion in the Program—as indicated in the Artist Release Form on the following page—you represent and warrant that:
You have all necessary rights, licenses, and authority to grant JAZZIZ the rights described herein;
You have obtained all necessary approvals and clearances from all applicable rights holders, including but not limited to artists, musicians, vocalists, producers, music publishers, unions, guilds, and other contributors;
No payments, royalties, or fees shall be due by JAZZIZ to you or any third party arising out of or in connection with the use of the Performance as contemplated herein; and
The use of the Performance and any related materials by JAZZIZ shall not infringe upon or violate the intellectual property or other rights of any third party.

License Grant

You hereby grant JAZZIZ a limited, non-exclusive, royalty-free, worldwide license to use, reproduce, display, distribute, and promote the Performance, the submitted track, album, and related artist materials (as provided by you), solely in connection with the Program. This includes the right to present the Performance to JAZZIZ’s global readership for promotional purposes during the one-month period as outlined above.

Additional Materials Required

To participate in the Program, you must complete and sign this form and the Artist Release Form on the following page for each Performance submitted. You must also provide the following materials:

Selected track (WAV audio file)
Album cover artwork (JPEG)
Artist biography
High-resolution artist photo(s) with proper credit (preferably in horizontal/landscape format)


Promotional Use

You authorize JAZZIZ to use the names, likenesses, biographical information, and any logos (if provided) of the artist(s), contributors, and/or your company in connection with promotional and advertising activities for the Program. This includes use in the digital flipbook magazine, on the JAZZIZ website, and in promotional campaigns, festivals, concerts, social media, and related marketing efforts.

Indemnification

JAZZIZ shall indemnify and hold you harmless from and against any and all claims, liabilities, damages, or expenses arising out of its use of the Performance in accordance with this Agreement, except where such claims arise out of your breach of the representations and warranties set forth herein.

Acceptance By signing below, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions set forth above.
